Bender quoted in ‘Republic’ article regarding Giffords’ shooting

, Professor of Law and Dean Emeritus, was quoted in a March 5
Arizona Republic
article entitled, “Loughner indicted on 49 counts,” by reporter Michael Kiefer.
The article discussed the recent federal indictment of Jared Loughner, who is accused of the Jan. 8 Tucson shooting that left six dead and 13 wounded, including U.S. Rep. Gabrielle Giffords. In addition to a federal trial, Loughner could also face a state trial in Pima County.
After the federal trial is complete, Loughner can be retried on similar counts in a state court without invoking double jeopardy because the case will be retired in a different jurisdiction, Bender said.
