Paul Bender was quoted on the new federal health care plan in a recent Capitol Times story posted on YourWestValley.com.

The March 22 article, "Disagreement whether Congress can mandate purchase of health insurance," by reporter Howard Fisher, said that Arizona Attorney General Terry Goddard thinks Congress is entitled to mandate that Arizonans purchase health insurance.

But Bender, who teaches constitutional law, told Fisher the authority of the federal government is not that clear.

Bender said there is a precedent of Social Security legislation, but the outcome will depend on whether the U.S. Supreme Court concludes it fits within the power of Congress to regulate interstate commerce.
