     A recent article, "High court's tilt hinges on election's outcome," written by San Francisco Chronicle reporter Bob Egelko and posted on the newspaper's Web site, sfgate.com, quotes College of Law professor Paul Bender.
     In relation to the court's recent pro-business ruling that a California law prohibiting using state funds for anti-union activities violates federal labor law, Bender said, "I think there are five to seven (justices) on the court who think that tort (damage) law has gone too far and is interfering with the way Congress wants to regulate business."
     Bender is also said to have agreed with other legal commentators in the opinion that should John McCain be elected, his subsequent appointee to the seat of any vacating liberal justice would cause the court to lean to the right.
