Karjala in 'Republic'
Professor Dennis Karjala
An article in
The Arizona Republic
about a copyright infringement lawsuit filed against a Valley tavern featured comments by Professor Dennis Karjala of the Sandra Day O'Connor College of Law.
The March 31 story, headlined "Lawsuit says bar skirted music fees," by reporter Erin Zlomek, said a lawsuit against Brookside Sports Bar & Grille in Surprise was filed in federal court by the American Society of Composers, Authors and Publishes, which alleges that the bar's owners played music without paying licensing fees for them.
The ASCAP's fees, which amounted to about $104 million in 2007, are a source of debate among restaurant and bar owners, Karjala said.
"Most think they are entitled to play music," he said. "In theory, you can't even turn on a boom box and walk down the street because that would be considered a public performance. I think ASCAP (the society) is just trying to educate people."
