‘Horizonte’ interviews A. Hessick on SB 1070
was a guest on Channel 8’s
on Wednesday, June 27, to explain parts of the U.S. Supreme Court’s ruling earlier in the week on S.B. 1070.
Hessick joined Valley attorneys Tim LaSota and Daniel Ortega, and guest host Richard Ruelas, a reporter at The Arizona Republic.
“This was a facial challenge, which means the law hasn’t been applied yet, so the justices had to say, ‘Well, could this law ever be constitutionally or lawfully applied?’ and they said, ‘Sure, we could imagine it being lawfully applied,’” Hessick said.
“Their opinion says that, in future cases, it might be applied in ways that raise Fourth Amendment problems or that raise pre-emption problems. If the stops last too long or if there isn’t an appropriate level of suspicion, then it’s going to be a problem,” he said.
