foreclosure mediation unit

The Foreclosure Mediation Unit is an initiative created by the Lodestar Dispute Resolution Program. It provides impartial mediation services between lenders and residential borrowers facing foreclosure and conducts educational programs for the general public related to housing issues. Students participating in the program who are enrolled at Arizona State University College of Law receive training in commercial mediation skills and have the opportunity to observe, co-mediate and participate in the administration of the program.

The Foreclosure Mediation Unit is currently administering a program to assist the United States Bankruptcy Court for the District of Arizona in the management of the increasing number of bankruptcy cases being filed in Arizona that involve disputes concerning residential mortgages and foreclosures.

The Program will address the need for facilitated negotiations in contested lift stay hearings under Title 11, Section 362 of the United State Code. The implementation of a foreclosure mediation program will endeavor to alleviate court congestion and delay by facilitating a home mortgage modification, deed in lieu of foreclosure or other negotiated settlement when such agreements are in the best interests of both the debtor and the secured creditor.

We are not taking referrals from sources other than the United States Bankruptcy Court for the District of Arizona at this time.

Timothy Burr and Art Hinshaw accept the 2012 Outstanding Practical Achievement Award from the International Institute for Conflict Prevention & Resolution for its innovative work in the field of alternative dispute resolution.
